to a number of considerations that those involved in, or
managing, ICT projects may need to address in developing
their contracts from this Model Agreement.
Mandatory Security
Provisions
The government has
decided that with effect from 1st July 2008, the
security provisions in the model agreement are to be
mandatory for all UK government ICT contracts. An
explanatory note has been prepared setting out the
full implications of this decision and identifying
sources of further advice on the new policy.
Information Assurance
A
short paper has been produced that describes how you should address
Information Assurance (IA) in your ICT contract. It
also sets out why the government is taking steps to
ensure that all ICT service contracts address the issue
comprehensively and effectively, and where you can find
expert advice to help.
Next Generation Networks
The Office of Government has produced a
set of standards to promote best practice in the
procurement of Next Generation Networks (NGNs) based
telecommunications entitled: Next Generation Networks
Procurement Standards, Guidance and Model Clauses.
AS NGNs are already being implemented and
will almost certainly become the most commonly used
infrastructure technology, all public sector
organisations should now be using these Standards in
order to ensure robust and reliable telecommunications.
It should
be noted that the contract terms in the standards have
been developed independently from this Model Agreement
and therefore may not be readily compatible (e.g. with
respect to consistent definitions). Although we believe
the NGN terms within the standards to be a sound basis
for procuring NGN services, professional legal advice
should be sought if they are to be incorporated into
this Model Contract.
